Agreement to Terms

By accessing or using SendMail's email marketing platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

Description of Service

SendMail provides an email marketing platform that allows you to create, send, and manage email campaigns, build subscriber lists, and analyze campaign performance.

Account Registration

To use our services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have legal authority to enter into agreements
  • Not share your account with unauthorized users

Acceptable Use Policy

You agree not to use SendMail to:

  • Send spam or unsolicited bulk email
  • Distribute malware, phishing attempts, or fraudulent content
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Send emails to purchased, rented, or harvested lists
  • Harass, abuse, or harm others

Email Compliance

You must comply with all applicable email laws, including:

  • CAN-SPAM Act (USA)
  • GDPR (European Union)
  • POPIA (South Africa)
  • Other applicable anti-spam legislation

This includes obtaining proper consent, providing unsubscribe mechanisms, and honoring opt-out requests.

Billing and Payment

  • Paid plans are billed in advance on a monthly or annual basis
  • Prices are subject to change with 30 days notice
  • Refunds are not provided for partial billing periods
  • We may suspend accounts with overdue payments

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.

Intellectual Property

You retain ownership of your content and subscriber data. You grant us a license to use this data solely to provide our services. SendMail and its branding are our intellectual property.

Limitation of Liability

SendMail is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of our services.

Termination

Either party may terminate the agreement at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your right to use the service ceases immediately.

Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of Zimbabwe. Any disputes shall be resolved in the courts of Zimbabwe.
